Introduction

The above-entitled matter came before the undersigned United States District Court Judge on December 15, 2005, pursuant to a Motion for Partial Summary Judgment brought by Plaintiffs Cardiac Pacemakers, Inc., and Guidant Sales Corporation (collectively, “Guidant”) and a Motion for Summary Judgment brought by Defendant Aspen Healthcare Metrics, LLC (“Aspen”).
