The appellant, Green Kilbourn, is the judge of the Lee County Court, and the appellee, S. K. Chapman, is a voter in and resident of Lee County. On August 5, 1914, the appellant, as county judge, issued against ap*137pellee a warrant, under Section 1978, Kentucky Statutes, charging him with the offense of suffering gaming on premises under his control, the punishment for which is fixed by the section, supra, at a fine of not less than $200.00 nor more than $500.00.
