APPEAL from an order of the Superior Court of San Joaquin County distributing the estate of a deceased person, and from an order refusing a new trial. Frank H. Smith, Judge. The facts are stated in the opinion of the court.

The record presents two appeals, one from an order distributing the estate of William Hartman, deceased, and the other from an order denying a new trial of the matter.

By the provisions of his will the deceased left the sum of two thousand dollars to the Stockton Branch of the California Conference Association of the Seventh Day Adventists, and the entire residue of his estate to the said California Conference Association of the Seventh Day Adventists. The petition for distribution stated these facts and asked distribution accordingly. The last-named body is an eleemosynary or charitable…
