This fause is now pending before the court upon an application by the plaintiff for an interlocutory injunction restraining the enforcement of a certain order made by the Michigan Public Utilities Commission establishing a new schedule of telephone rates to be charged by the plaintiff, on the ground, as alleged in the bill of complaint herein, that such rates are confiscatory, and such order in violation of the federal Constitution and void.
