— -Affirming.

This is the second appeal of this case. On the first trial appellant obtained a judgment for $2,000, which was reversed, with directions to the lower court to instruct the jury to return a verdict for the railroad company, if the evidence should be substantially the same on another trial. A peremptory was given by the court on the last trial, and appellant is complaining because he thinks he made out a case which should have been submitted to a jury.
