This is the second appearance of this case in this court. See 229 Ky. 627, 17 S. W. (2d) 748. The state highway commission of Kentucky, in accordance with section 4356t-7, Ky. Stats., on April 26, 1928, instituted,' in the county court of Perry county, Ky., condemnation proceedings to condemn for highway purposes .871 of an acre of land owned by A. B.
