The facts necessary to an intelligible understanding of the questions arising in the record for our decision are substantially the following:

The complaint was filed May nth, 1868, by J. and J. Slevin & sons, wholesale dry goods merchants of Cincinnati, against Margaret McGoldrick and husband, G. H. and H. McFadden, Rudolph S. Ford, Joseph Sheern, and Ellen Cox. It contains the following allegations, verified by affidavit of the plaintiffs’ agent: That Margaret McGoldrick, formerly McHugh, prior to April nth, 1864, was engaged in the retail dry goods business in Lafayette, and between that…
