HAIGHT, District Judge.

This suit is for an alleged infringement of letters patent No. 1,011,450, issued to the plaintiff, as assignee of Albert De Laski and Peter D. Thropp, December 12, 1911. The answer denies infringement, and alleges that the patent is invalid.

[1] In support of the latter defense, it is contended that, in view of the prior state of the art, the patent involved no invention, and that, if it did, it was not the joint invention of De Laski and Thropp, but the sole invention of Thropp. The subject-matter of the patent is a machine for wrapping fabric around automobile tires…
