Appeal from a judgment of the superior court for King county, Mackintosh, J., entered December SI, 1915, upon findings in favor of the plaintiff, after a trial before the court and an advisory jury.

This case was considered by this court, and opinion rendered that the contract relied on by appellant and sought to be cancelled and set aside upon the ground of fraud in its procurement was not void for uncertainty. The case was remanded for judgment unless respondent, upon the issues joined, sustained his charge of fraud. Faucett v. Northern Clay Co., 84 Wash. 382, 146 Pac. 857. The contract is fully set out in our former opinion. The case came on for trial. A jury was called to advise the court by its verdict.
