This is an appeal from a judgment entered by Judge John R. Bartels upon a jury verdict convicting Jerome Evans of one count of armed bank robbery in violation of 18 U.S.C. § 2113(d) 1 and § 2 and one count of bank robbery in violation of 18 U.S.C. § 2113(a) 2 and § 2. Since a conviction of bank robbery pursuant to § 2113(a) is deemed merged into a conviction of armed bank robbery pursuant to § 2113(d), we reverse and remand to the district court with directions to vacate the conviction pursuant to 18 U.S.C. § 2113(a) and the sentence thereon. 3
