Action to enforce a lien for street-work, claimed under the mechanic’s lien law. Plaintiff had judgment, from which defendants appeal, on bill of exceptions.

This is the second appeal of the case. In the first appeal the judgment for plaintiff was affirmed in Department (Santa Cruz Rock Pav. Co. v. Lyons, 43 Pac. Rep. 599); on rehearing in Bank, the judgment was reversed on the ground that section 1191 of the Code of Civil Procedure is unconstitutional, in so far as it attempts to impose a hen on land by virtue of an agreement on the part of one who is merely reputed to be the owner…
