This appeal is taken from that part of the decree of distribution which gives to the California Annual Conference of the Methodist Episcopal Church a legacy of five thousand dollars, together with interest.

Mary E. D. Goodfellow died testate August 21, 1907. Her will was dated February 19, 1886. By the first provision of the will the sum of twelve thousand dollars was bequeathed to William Goodfellow, husband of the testatrix, the income from that amount to be paid to him annually by the executors of Mrs. Goodfellow’s estate.
