This cause is before the Court on the following Motions:

1) the Motion for Summary Judgment of Plaintiff John Barton and Plaintiff Robert Butler; and

2) the Motion for Summary Judgment of Defendant Fred Netterville Lumber Co. (hereinafter “Netterville”).
