The following statement of facts disclosed by the complaint is sufficient for the determination of questions presented in support of the assignment that the court erred in overruling the demurrer thereto: On September 9, *4851909, and for a number of years prior thereto, the Evansville Electric Railway Company was operating an electric street railway in the city of Evansville under an ordinance of the city.
