Moore, Justice:

This is a wrongful death action brought by the estate of Janie Mae Stokes (Estate). The jury awarded the Estate $3,300.00. The trial judge granted a new trial nisi additur to $75,000.00, which Respondent/Appellant Denmark Emer gency Medical Services (Denmark EMS) declined. Both parties appeal. We affirm.

FACTS
