The plaintiff on October 19, 1937, entered into a written contract with Ailing & Miles, Inc., a retail auto dealer, to purchase a new Hudson automobile for $1,335. The plaintiff was to receive an allowance of $610 for his old car, on which he still owed Ailing & Miles, Inc., a sum adjusted at $250, to pay $75 in cash, and the balance, which amounted to $900, to be paid at the rate of $40 a month for eleven months and the remainder the twelfth month.
