CLIFFORD, Justice.
[¶ 1] Jerald E. Greenvall, the personal representative of the estate of Carla Madore, appeals from a summary judgment entered in the Superior Court (Kennebec County, Alexander, J.) in favor of Maine Mutual Fire Insurance Company (Maine Mutual) on his complaint asserting breach of contract, bad faith and late payment claims. We agree with Greenvall’s contention that there is a genuine issue of material fact on the breach of contract claim, and therefore we vacate the judgment on Count I of the complaint. We affirm the judgment on Counts II and III of the complaint.
