On this appeal we must decide whether a state court has jurisdiction to determine the legality of a collective bargaining agreement containing a nondiscriminatory hiring hall provision before the agreement is signed by the employer and the union. The lower court assumed jurisdiction to make that determination, and awarded damages to the picketed employer. It is conceded that the employer’s business operations affect commerce within the meaning of the National Labor Relations Act as amended, 61 Stat. 136-159 (1947), 29 U.S.C., §§ 141-187 (1958).
