MARTIN, Chief Justice.

An appeal from a judgment for the defendants in an action brought by appellant to recover a deficiency judgment on a promissory note secured by a deed of trust.

It appears that on June 2,1927, Margaret C. Dumas, since deceased, sold and conveyed certain real estate situate in the District of.' Columbia to John T. Rhines and wife, and received in part payment of the purchase price a promissory note signed by the purchasers payable to the order of Mrs. Dumas in the sum of $10,750, secured by a second deed of trust upon the property.
