Police appeals as of right from an order denying its motion for summary disposition. We affirm.
FACTUAL AND PROCEDURAL BACKGROUND
On September 16, 2000, Michigan State Police Trooper John Janicki was responding to a reported breaking and entering in progress when he collided with a vehicle driven by the decedent, John Newton.
