Appeal from an order denying defendant’s motion in the alternative for judgment notwithstanding the verdict or a new trial.

Defendant owned and operated a theater in Minneapolis. Plaintiff attended a performance therein during the afternoon of June 5, 1925, and had occasion to go to the women’s rest room. She drew the curtain of the doorway opening onto the stairway leading down to the rest room. This was a carpeted stairway about five feet wide with a handrail in the center and one on each wall.
