This cause is here on appeal on questions of law.

From the record, the following are the facts: On the 15th day of June 1942, an employee of the plaintiff, appellee herein, drove a tractor-trailer outfit, loaded with soy beans, to the plant of the defendant, appellant herein, located at Marion, Ohio.
