PICKETT, Circuit Judge.

The plaintiffs, as owner and tenant of a building in Denver, Colorado, brought this action to recover damages to the building caused by a fire occurring after the defendant, Underwriters Salvage Company of New York, 1 had entered into the performance of a contract with the plaintiff, Davis and Shaw, and others, to remove from the building all the furniture therein which had been damaged by a previous fire. The complaint alleged that on August 3, 1948, a fire occurred which damaged the furniture and other articles stored in the plaintiffs’ warehouse building, and that…
