NORCROSS, District Judge.
This is an action at law to recover the balance of the .purchase price of certain property in pursuance of the terms of a written agreement for the sale and purchase thereof for a consideration of $20,000, payable in installments. By the terms of the agreement, upon making the initial payment and the deposit of the agreément in escrow, the defendant purchasers were entitled to possession. Defendants entered into possession and thereafter paid the next installment payment, but defaulted in the making of the third payment in the sum of $2,500, due October 1, 1932,…
