WALLACE, Circuit Judge.

This is a writ of error by the defendant in the court below to review a judgment for the plaintiffs entered upon the verdict of a jury. The action was, brought upon a bond, dated May 29, 1893, which was, in effect, a contract by the defendant to insure Charles P. Wood & Co., to the extent of $10,000, against losses for merchandise sold or to be sold by them during the year 1893, arising from insolvency of debtors.
