Plaintiff, siting on behalf of himself and other stockholders of the Provident Savings Life Assurance- Society of New York, alleges in his complaint that the society is a corporation organized and existing under the laws of. the State of New York for the purpose of conducting the business of life insurance -; that under its. charter its corporate powers are vested in a board of directors of fifteen pier-sons, divided into four classes, four directors retiring each year,..with the exception only that three directors retire every fourth year; that the plaintiff is the' owner and…
