1Opinion of the CourtSutherland, J.
The act of the legislature, passed April 17, 1867, (Laws of 1867, ck. 410, § 1,) provides: “ Immediately after the passage of this act, the governor shall appoint, by and with the advice of the senate, three commissioners of taxes and assessments f#r the city and county of New York, and upon their acceptance of the said office, the term of office of the present commissioners of taxes and assessments for said city and county shall be terminated.”
