This is an appeal by plaintiff from a judgment in favor of defendant entered on a jury verdict in the district court of Gallatin County, and from an order denying the motions of plaintiff for directed verdict, judgment notwithstanding the verdict, or in the alternative for a new trial.

The accident forming the basis of this case occurred at approximately 1:30 a.m. on May 16, 1970, on U.S. Highway No. 10 between Bozeman and Belgrade, Montana. Defendant was pro ceeding in a northerly direction on Highway No. 10 near the second viaduct going to Belgrade, when the accident occurred.
