Plaintiff, William Romano, is a resident of Macomb county, Michigan, and a duly elected member of the house of representatives from the second district in said county. He filed a petition in the Supreme Court for a writ of mandamus commanding defendant Murl K. Aten, auditor general of the State of Michigan, to issue a check for the amount of salary due as provided in Act No. 5, Pub. Acts 1948 (2d Ex. Sess.).
