Defendant, Paul Barick, was convicted in the district court of the crime of burglary in the first degree and was thereupon sentenced to serve a term of eight years in the state penitentiary. From this verdict and judgment he appeals.

The information charged that the defendant “on or about the 4th day of October, A.D., 1960, committed the crime of Burglary, in that the said Paul Barrick [sic], then and there being, then and there did, wilfully, unlawfully, feloniously, intentionally, and burglariously, with the intent in him, the said Paul Barrick [sic], then and there and therein, to commit…
