The defendant appeals from an order denying his motion for a new trial, and from a judgment of conviction of the crime of murder in the second degree.
*72The defendant, George S. Geddes, and Thomas Welch and Richard Dixon were jointly informed against for the crime of murder. The information charged that on November 4, 1897, at Custer county, this defendant and the other persons above named shot and killed Clemence W. Brown, who is spoken of throughout the record, and whom we shall designate as Winnie Brown. The information is in the usual form of a charge of murder in the first degree.…
