Appeal from the District Court, Deer Lodge County. STATEMENT. The defendant, Dennis Mantón, was indicted for the murder of his wife, Susan E. Mantón. He left her lying outside of their house in the snow one winter-flight, and death resulted from the exposure. He was tried in the District Court of Deer Lodge County, at the April term, in 1887, found guilty of murder in the second degree, and sentenced to twenty years in the penitentiary.

The prisoner in this case was convicted of manslaughter in the District Court of Deer Lodge County on the twentieth day of December, 1887, and was sentenced to imprisonment in the territorial prison for ten years. There was a motion for a new trial, which was overruled, and an appeal taken to this court. This case was before us at the July term, 1887, and was then reversed and remanded for a new trial, upon the ground of an erroneous instruction inadvertently given. (See 7 Mont. 162.)
