This is an appeal from an order amending a judgment to conform to the original order for judgment; and from the judgment as amended, which is the substituted judgment in this case.

This action was commenced in June 1927 for the purpose of cancelling a contract for the sale of land entered into by and between one J.W.K. and this defendant, which contract was assigned, transferred and set over to the plaintiff.
