OPINION

MONTGOMERY, District Judge:

Plaintiff-Appellee Marco Antonio Corona-Contreras (“Contreras”) sued Defendant-Appellant Steven Gruel (“Gruel”) in California state court for, among other things, breach of contract and legal malpractice. Eleven months later, Gruel removed the case to federal court on the basis of diversity and federal question jurisdiction. Contreras did not object to the removal or file a motion to remand. More than three months after the case had been removed, the district court sua sponte found the removal to be untimely and remanded the case back to state court. Gruel…
