Petitioner C.E. “Sam” Hall, Prosecuting Attorney of Boone County, seeks to prohibit the enforcement of an order entered by the Circuit Court of Boone County on October 9, 1997, which dismissed the State’s information against Respondent Charles Gregory Brown for operating a motor vehicle during a period when his operator’s license had been revoked for driving under the influence (“DUI”).
