I. Introduction
On June 15, 2006, Time Warner Cable, Inc. (“TWC”) filed a complaint against USA Video Technology Corporation (“USVO”) seeking a declaratory judgment of noninfringement, invalidity, and unenforceability of United States Patent No. 5,130,792 (“the '792 patent”), entitled “Store and Forward Video System.” 1 The '792 patent is directed to systems that transmit video programs to subscribers upon request, commonly referred to as video-on-demand (“VOD”). 2 TWC allegedly operates digital cable systems that provide VOD…
