INTRODUCTION
Before the Court is defendant Inter-search Group, Inc.’s Motion to Dismiss (the “Motion”) [Docket No. 5]. Defendant Intersearch Group, Inc. (“defendant”) requests this Court to dismiss plaintiff Inter-search Worldwide, Ltd. (“plaintiff’) under the first-to-fíle doctrine, on the grounds defendant filed an action similar to this one, against plaintiff, in the Southern District of New York, before plaintiff filed this one.
