Petitioner seeks a construction of the last will and testament of Jane Mogg, dated August 30, 1947, which was admitted to probate on December 20, 1960. Letters testamentary were issued to Andrew Mogg, the surviving husband, on the date of admission to probate.

The residuary clause of the will gives all the rest, residue and remainder of the decedent’s property to Andrew Mogg. The first clause of the will provides for payment of the debts and funeral expenses. The second clause which is the object of the proceeding for construction is as follows: “ I give, devise and…
