This action was instituted by the state of Montana as plaintiff against W. L. Kearns as administrator of the estate of Joseph Brown, deceased, and the American Surety Company as bondsman for the administrator, to recover the sum of #5,390.52, alleged to have escheated to the state. After the defendants had filed their answer, the cause was submitted to the court for decision upon an agreed statement of facts, supplemented by oral testimony and documentary evidence introduced on the part of the plaintiff.
