By an order duly made and entered in the probate court of Ramsey county, Minnesota, on October 28, 1918, plaintiff, a resident of this state and former wife of defendant J. A. Kelly, hereinafter called defendant, was committed to the State Hospital for the Insane at St. Peter, Minnesota, as an insane person. Thereafter, and on November 8, 1918, defendant filed in the district court of Rosebud county a petition praying that he be appointed guardian of the person and estate of plaintiff.
