Defendants Garth A. Drabinsky (“Dra-binsky”), Myron Gottlieb (“Gottlieb”), Robert Topol (“Topol”), Maria M. Messina (“Messina”), H. Garfield Emerson (“Emerson”), Martin Goldfarb (“Goldfarb”), A. Alfred Taubman (“Taubman”), 1 and De-loitte & Touche Canada (“D & T”), have moved to dismiss this action, pursuant to Rule 9(b) of the Federal Rules of Civil Procedure, for failure to plead scienter and fraud with sufficient particularity.
