Before considering the case on its merits, it is necessary to examine its status in this court. The territorial supreme court dismissed the appeal on appellees’ motion, for the reason that the clerk of the trial court had failed to indorse on the appeal bond his approval thereof. At the incoming of the state supreme court the case was pending on a motion by appellant to reinstate.
