This action was commenced February 22, 1927, by W. V. Knight against Merritt Engineering & Sales Company to recover damages in the sum of $3,000 for alleged breach of warranty growing out of the sale of a veneer drying plant to plaintiff by defendant. Some time prior to January 28, 1926, the plaintiff, who was then engaged in the veneer business in Dillon,-entered into- negotiations with the defendant company, a manufacturer of a machine for drying veneer strips, with its plant at Dockport, N. Y., for the purchase of such a machine.…
