Appellant Wilkins, Stanton, and Miller were charged by information with armed robbery, in violation of Penal Code, section 211, and appellant was further charged with a prior felony conviction for robbery in Missouri in 1954.

At the preliminary hearing on August 2, appellant and Stanton were represented by the same deputy public defender, and Miller by other counsel. When arraigned in superior court, a not guilty plea and denial of the prior were entered on behalf of appellant.
