MEMORANDUM OPINION DENYING CIT’S MOTION FOR SUMMARY JUDGMENT

I. THE ISSUES.

Before the court is Defendants’ motion for summary judgment on the Chapter 7 Trustee’s complaint to avoid alleged preferential transfers under 11 U.S.C. § 547(b). The Debtors are Merry-Go-Round Enterprises, Inc. and certain affiliates (collectively “MGRE” or “Debtors”). 1 Plaintiff is the Trustee appointed after MGRE’s Chapter 11 reorganization case was converted to Chapter 7 (“Chapter 7 Trustee”).
