MEMORANDUM OPINION AND ORDER

BATTISTI, Chief Judge.

This matter is before the Court on cross-motions for summary judgment. Under Rule 56 of the Federal Rules of Civil Procedure, summary judgment may be granted only if the court, viewing all the evidence in the light most favorable to the opponent of the motion, concludes that no genuine issue of material fact exists and that the movant is entitled to judgment as a matter of law.
