This is a motion for summary judgment by plaintiff Topps Chewing Gum, Inc. (hereinafter “Topps”) limited to the issue of liability for alleged breach of a license and trademark agreement by the defendant Imperial Toy Corporation (hereinafter “Imperial”), and also a motion for dismissal of Imperial’s four counterclaims. 1 At the same time Imperial cross-moves for summary judgment with respect to its counterclaims for breach of contract and for breach of express warranty of title.
