The plaintiff in error, hereinafter called defendant, with two others, was informed against in the district court of Canadian county for the larceny of domestic fowls in the nighttime. A severance was had; the defendant tried alone; the jury returned its verdict finding him guilty, and fixing hi's punishment at 4 years in the state penitentiary.

Several assignments of error are presented in the brief, and such as are deemed material will be considered. It is first argued that the court erred in permitting the county attorney to amend- the information after the jury had been impaneled. It…
