The plaintiff in error, hereinafter called defendant, was convicted in the district court of Tulsa county on a charge of robbery with firearms, and sentenced to serve a term of 25 years in the state penitentiary.

On the night of the 27th day of October, 1923, one Gilmer, a street car conductor, was held up and robbed on his car in the suburbs of the city of Tulsa. The robbery was done by two persons — one of whom was partially masked with a handkerchief covering his nose and the lower part of his face; the other was unmasked.
