On the night of December 29, 1922, the plaintiff in error shot and killed J. H. Ferguson on West California street, Oklahoma City. The killing took place at a rooming house kept 'by Mrs. Rosa Walker. It appears that plaintiff in error and the deceased Ferguson had formerly been associated together as private detectives, and had had a misunderstanding or difficulty, and had not met for some little time before the night of the homicide.
